PHC issues notices to MI, ISI in cases of missing persons

PESHAWAR: The Peshawar High Court on Thursday issued notices to Khyber Pakhtunkhwa chiefs of Military Intelligence (MI) and Inter-Services Intelligence (ISI), commandant Mahsud Scouts and Defence and Interior ministries in missing persons’ cases.

A PHC division bench, comprising Chief Justice Ejaz Afzal Khan and Justice Mazhar Alam Miankhel, in the first missing case, issued notices to Khyber Pakhtunkhwa chiefs of MI and ISI and commandant of Mahsud Scouts, directing them to submit written comments about the whereabouts of two missing persons.

Luqman, resident of Akakhel Bara in Khyber Agency, had filed a habeas corpus petition in which he claimed that on January 7, 2010, the assistant political agent (APA), Bara, arrested his father Abdul Majan and brother Shahid and handed them over to personnel of intelligence agencies, and since then their whereabouts were not known.

Iqbal Durrani, counsel for APA Bara, submitted written comment of his client in which he showed his ignorance about the whereabouts of the missing persons. The bench issued notices to the provincial chiefs of the intelligence agencies and commandant of Mahsud Scouts to explain their positions in the case. The bench issued notices to the Defence and Interior ministries in a second missing person case, directing them to search out and file comment in the next hearing.

Haji Payo Gul, resident of Ziarat Kaka Sahib in Nowshera district, had filed a habeas corpus petition, through advocate Mohammad Saadullah Kakakhel. The petitioner claimed that station house officer of Nowhsera Kalan Police Station and intelligence agencies personnel picked up his son Suleman, a second-year student from his house on October 20, 2010.

In the third missing case, the deputy attorney general informed the court that the Defence and Interior ministries had sought more time for searching out the missing person with the spy agencies working under them. Relatives of missing Ziaullah, a resident of Sawaldher in Mardan district, had filed a petition in the court, claiming that an anti-terrorism court on October 13, 2010, acquitted Ziaullah of terrorism charges, but security agencies picked him up from the premises of Mardan prison when he was released from jail. The bench summoned station house officer of Chamkani Police Station on Febuary 16 in the fourth missing person’s case. Two women, including, Ruqayya and Dilshad on Wednesday requested Chief Justice Ejaz Afzal Khan to order recovery of their husbands who were picked up by local police some 11 days ago, and since then their whereabouts were not known to them. The women were wives of two brothers Mikael Khan and Ali Akbar and residents of Tambarpura village in Peshawar district. The women said that they belonged to a poor family, and their husbands were labourers.
